Welcome to Pocketclick! These Terms of Service ("Terms") govern your use of the Pocketclick mobile application and services (the "Service"). By creating an account, you agree to these Terms. Pocketclick is a marketplace connecting clients who need photography services with professional photographers.
2.1 Registration • You must provide accurate information when creating your account • You must be at least 18 years old to use Pocketclick • You are responsible for maintaining the security of your account • You may not share your account with others 2.2 Account Types • Client Account: book photographers for your sessions • Photographer Account: offer your photography services • Users may hold both roles simultaneously
3.1 Acceptable Use You agree to: • Use the Service for lawful purposes only • Treat other users with respect • Provide accurate information in bookings • Honour your commitments (bookings, availability) 3.2 Prohibited Activities You may NOT: • Harass, threaten, or discriminate against other users • Share inappropriate content • Bypass payment systems or platform fees • Attempt to circumvent security measures • Use the Service for spam or fraud • Solicit or arrange bookings outside the Pocketclick platform with users you met through Pocketclick, for the purpose of avoiding platform fees. Doing so may result in account suspension.
4.1 Making Bookings • Bookings are confirmed when payment is processed • You agree to the photographer's package terms and pricing • Meeting locations and times are agreed between client and photographer 4.2 Cancellation Policy — Client Pocketclick operates four booking flows. Cancellation rules depend on the booking type: Calendar Booking: • More than 24 hours before the shoot: full refund • 24 hours or less before the shoot: 50% refund Client Spot Booking: • Within 2 hours of creating the booking (grace period): full refund, regardless of shoot time • After the 2-hour grace period, more than 24 hours before the shoot: full refund • After the 2-hour grace period, 24 hours or less before the shoot: 50% refund Photographer Spot Booking: • More than 2 hours before the slot: full refund • 2 hours or less before the slot: 50% refund Spontaneous Booking: • Spontaneous bookings are immediate and cannot be cancelled by the client once payment is confirmed. In all cases where a partial refund applies, the photographer receives 85% of the non-refunded amount after a 7-day hold period. Stripe payment processing fees are not deducted from client refunds. 4.3 Cancellation Policy — Photographer If a photographer cancels a confirmed booking, the client receives a full refund regardless of timing. Photographers who repeatedly cancel confirmed bookings may face account suspension. 4.4 Modifications • Reschedule requests for calendar bookings must be submitted more than 24 hours before the shoot • Both parties must agree to any reschedule • Original cancellation policies apply to rescheduled bookings 4.5 Photographer Service Delivery Photographers agree to perform the booked photography service as described and to deliver the resulting photos to the client within the timeframe agreed in the booking or in-app chat. Failure to deliver the agreed service may result in a full or partial refund to the client at Pocketclick's discretion, and may lead to account suspension for repeated failures. 4.6 Photographer Legal Obligations By accepting bookings through Pocketclick, photographers agree to: comply with all applicable local, national, and international laws and regulations; obtain any permits or permissions required to shoot in specific locations; maintain any professional insurance required by their local law; respect client privacy during and after the shoot; and comply with applicable data protection laws (including GDPR where relevant) regarding any personal data they access through the platform.
5.1 Payments • All payments are processed securely through Stripe • Prices are displayed in the photographer's chosen currency (e.g. EUR, USD, GBP). The applicable currency and total amount are shown before you confirm your booking. • The price shown at booking is the total amount you pay as a client. Pocketclick's platform fee is deducted from the photographer's payout — there are no hidden fees charged to clients. • Pocketclick takes a service fee from photographers on each completed booking 5.2 Refunds • Refunds are processed according to the cancellation policy in Section 4 • Refunds may take 5–10 business days to appear depending on your bank • In cases of partial refund, the remaining amount is transferred to the photographer after a 7-day hold 5.3 Photographer Payouts • Payouts are processed after a 7-day hold following booking completion • Requires a valid, verified Stripe Express account • Subject to Stripe's terms and payout schedules • Photographers are solely responsible for declaring and paying any taxes, social contributions, or other obligations arising from their earnings through Pocketclick, in accordance with the laws of their country of residence.
6.1 Your Content • You retain full ownership of all photos and content you upload • By uploading content, you grant Pocketclick a non-exclusive, worldwide, royalty-free licence to store, display, resize, compress, cache, and promote that content for the purpose of operating and marketing the Pocketclick platform, for as long as the content remains on the platform • This licence does not transfer ownership and does not allow Pocketclick to sell your content to third parties • You must have all necessary rights to any content you upload; you may not upload content that infringes the intellectual property or privacy rights of any third party 6.2 Platform Content • Pocketclick owns all platform design, code, branding, and original content • You may not copy, reproduce, or redistribute platform content without prior written permission
7.1 Marketplace — Not an Employer Pocketclick is a technology platform that facilitates connections between independent photographers and clients. Photographers are independent professionals, not employees, agents, or representatives of Pocketclick. Pocketclick does not direct, supervise, or control how photographers perform their services. Each photographer is solely responsible for the quality, safety, and legality of the services they provide. Clients contract directly with the photographer for the photography service itself; Pocketclick's role is limited to providing the booking platform. 7.2 Service Provided "As Is" • We provide the platform to connect users • We do not guarantee photographer quality, conduct, or availability • We are not a party to the service agreement between client and photographer • We are not responsible for disputes arising from the performance of photography services 7.3 Limitation of Liability • Pocketclick's liability is limited to the amount you paid in the past 12 months • We are not liable for indirect, incidental, or consequential damages • This does not affect your statutory rights under applicable law 7.4 Force Majeure Pocketclick is not liable for any failure or delay in providing the Service caused by circumstances beyond our reasonable control, including outages of third-party providers (such as payment processors or cloud infrastructure), natural disasters, or government action. 7.5 Indemnification • You agree to indemnify Pocketclick against claims arising from your use of the Service, your content, or your breach of these Terms
8.1 User Disputes • Disputes between users should be resolved directly • Pocketclick may mediate but is not obligated to • Repeated disputes may result in account suspension 8.2 Legal Disputes • These Terms are governed by the laws of France • Any dispute that cannot be resolved amicably shall be submitted to the competent courts of Paris, France • Nothing in these Terms affects any mandatory consumer protection rights you may have under the laws of your country or state of residence that cannot be excluded or limited by contract.
9.1 Updates • We may update these Terms at any time • We will notify you of material changes via email or in-app notification • Continued use after changes constitutes acceptance 9.2 Version Tracking • Each version is numbered and dated • You accepted Version 1.2 when you created your account or were notified of this update
10.1 Your Rights • You may delete your account at any time via Settings → Delete Account • See our Privacy Policy for data deletion procedures 10.2 Our Rights We may suspend or permanently terminate any account, at our discretion, for reasons including but not limited to: • Breach of these Terms • Fraudulent, deceptive, or misleading behaviour • Behaviour that poses a safety risk to other users • Repeated complaints or disputes from other users • Uploading fake, stolen, or misleading portfolio content • Copyright infringement or intellectual property violations • Any conduct that damages Pocketclick's reputation or platform integrity We may terminate the Service itself with 30 days' notice.
